Recent court decisions have limited patentable subject matter which has consequently increased the importance and value of proprietary scientific data. In addition, the push towards big data, and the rise of privacy and information security concerns in both the clinical care and medical research settings, have highlighted the importance of sound data handling practices. This discussion of best practices for licensing research data, especially health data, will include considerations for using, transferring and otherwise harnessing data in licensing. Other topics include obtaining and using data in a permissible manner, including so-called secondary uses of data beyond the original research study, and issues relating to data repositories, both open and closed.
